CHALLENGER CHALLENGE TERMS AND CONDITIONS


To promote the launch of the new Indian Challenger motorbike, Polaris Sales Australia Pty Ltd ABN 62 088 081 949, of 36 Grimes Crt, Derrimut Victoria 3030, 03 9394 5610 trading as Indian Motor Cycle Australia (“Indian Motorcycle”) is conducting a promotion (the “Challenger Challenge”) on the terms and conditions below.


1.By entering and participating in the Challenger Challenge, entrants are deemed to have acknowledged and accepted these terms and conditions.


2.The Challenger Challenge commences at 9:00am AEST on 1 July 2020 and closes at 5.00pm AEST on 30 September 2020 (the “Promotion Period”).


3.To be eligible to enter the Challenger Challenge (“Eligible Entrant”), you must:

a.be aged 18 years or over;

b.hold a current and valid Australian motorcycle licence; and

c.comply with these terms and conditions.


4.Eligible Entrants who complete all of the following requirements during the Promotion Period will, subject to these terms and conditions, be sent AUD$500 via bank transfer within 30 days of the completed entry form being submitted:

a.Test ride an “Indian Challenger” motorbike at a participating Indian Motorcycle dealership (please contact your dealership first to ensure they are a participating dealership and have a motorbike available to test ride);

b.Test ride, then purchase, a new 2020 Harley Davidson Road Glide Special motorbike after the date of the “Indian Challenger” test ride;

c.Visit a participating Indian Motorcycle dealership and complete the entry form provided for the Challenger Challenge, which will require you to:

i.provide evidence of your test ride of an Indian Challenger during the Promotion Period (including the date and location of the test ride);

ii.provide the original contract of sale and a copy of the original signed contract of sale of the new 2020 Harley Davidson Road Glide Special motorbike during the Promotion period as evidence of your purchase, which must be in the Eligible Entrant’s name. Entrant must take delivery of the Harley during the campaign period. No payments will be granted until the Harley is in the customer’s name that corresponds with the test ride and contract details;

iii.provide your contact details, including your name, phone number, email address and postal address;

iv.provide your bank account details, including BSB and account numbers; and

v.agree to receiving marketing communications from Indian Motorcycle as further set out below.


5.Indian Motorcycle will review your completed entry form provided by its participating Indian Motorcycle dealership to validate that you are an Eligible Entrant and have completed the requirements above. If you have, Indian Motorcycle will process the transfer of AUD$500 to the nominated bank account provided to the person named as the purchaser on the contract of sale for the Harley Davidson Road Glide Special motorbike.


6.Eligible Entrants will only be entitled to one AUD$500 payment even if they purchase more than one new 2020 Harley Davidson Road Glide Special motorbike during the Promotion Period.


7.Entries received by Indian Motorcycle outside the Promotion Period (irrespective of when they were sent) will not be eligible to receive the AUD$500 payment.


8.Indian Motorcycle takes no responsibility for late, lost, incomplete, inaudible, indecipherable or incorrectly submitted, illegible, misdirected or invalid entries, delays or failures in any equipment or telecommunications service used to administer the Challenger Challenge.


9.Indian Motorcycle may, in its absolute discretion, declare an Eligible Entrant’s entry invalid, or disqualify any entrant that tampers with the entry process or benefits from such tampering, submits an entry that is incomplete or not in accordance with these terms and conditions, or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of the Challenger Challenge.


10.Indian Motorcycle reserves the right to require an entrant to verify the validity of their entry within a requested time, including but not limited to an entrant’s identity, eligibility, age, address and compliance with the entry requirements above, and to disqualify any entrant who does not satisfy any entry criteria in these terms and conditions. If there is a dispute as to the identity of an entrant, Indian Motorcycle reserves the right, in its sole discretion, to determine the identity of the entrant. Errors and omissions may be accepted at Indian Motorcycle’s sole discretion. Proof considered suitable for verification is at the Indian Motorcycle’s discretion.


11.If for any reason the Challenger Challenge is not capable of running as planned, or is interfered with or disrupted in any way (including but not limited to, by vandalism, power failures, natural disasters, acts of God, weather event, civil unrest, strikes, computer bugs or viruses, tampering or technical failures, disease or pandemic, any government directive, or any changes whatsoever made by Harley-Davidson in relation to their motorcycles), Indian Motorcycle reserves the right to cancel, terminate, modify or suspend it.


12.All of Indian Motorcycle's decisions in relation to all aspects of the Challenger Challenge are final and no correspondence will be entered into.


13.The Challenger Challenge is in no way endorsed or associated with Facebook, Twitter, Instagram, Woobox or any other such platform used to promote it.


14.Entrants’ personal information is collected by or on behalf of Indian Motorcycle (and its participating authorised dealerships) to enable us and our agents to manage and administer and promote the Challenger Challenge. We will disclose entrants’ personal information and/or collect personal information about entrants in its business functions and activities and for the purposes detailed in these terms and conditions. By participating in the Challenger Challenge, you consent to these uses and disclosures.


15.Participation in the Challenger Challenge allows Indian Motorcycle and our related companies (“we”/”us”) to let you know from time to time about news, offers, products and services you might be interested in (by any medium, including telephone, email, mail, SMS or online marketing). In order to carry out direct marketing, entrants’ personal information will be collected from and disclosed to others that provide us with specialised data matching, trending or analytical services, as well as general marketing services. We, and other people who provide us with services, may combine the personal information collected from entrants or others, with the information we, or other companies in the Polaris Sales Australia Pty Ltd group, or our service providers already hold about entrants. We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance. It is a condition of entry that Eligible Entrants consent to receive these marketing communications, although Eligible Entrants may later opt out of, or unsubscribe from, receiving marketing communications at any time, under applicable legislation.


16.If an entrant does not provide the personal information Indian Motorcycle requests, we may not be able to provide entry into the Challenger Challenge. All personal information is handled in accordance with these terms and conditions and our privacy policy.
